Welcome to **CHINKY**! These Terms of Service ("Terms") govern your access to and use of the CHINKY mobile applications, websites, APIs, and associated services (collectively, the "Platform" or "Services"), operated by CHINKY ("we", "us", or "our").
By downloading, registering for, accessing, or using CHINKY, you agree to be bound by these Terms and our [Privacy Policy](/privacy-policy). If you do not agree to these Terms, do not use the Services.

1. Eligibility & Age Requirements
- **Minimum Age**: You must be at least **13 years old** (or the minimum legal age required in your country or jurisdiction to use social media services) to create an account and use CHINKY.
- **Parental Consent**: If you are between 13 and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
- **Authority**: If you use CHINKY on behalf of a company, organization, or other entity, you represent and warrant that you are authorized to bind that entity to these Terms.

2. Account Registration & Security
- **Accurate Information**: You agree to provide accurate, current, and complete registration information and keep your details updated.
- **Account Security**: You are responsible for safeguarding your login credentials (username, password, and two-factor authentication codes). You must not share your account or credentials with anyone.
- **Account Activity**: You are solely responsible for all activities that occur under your account. If you believe your account has been compromised, notify us immediately at **support@chinkyapp.com**.
- **One Account Per Person**: Creating multiple automated, deceptive, or spam accounts is strictly prohibited.

3. User Conduct & Community Guidelines
CHINKY is a positive, creative, and safe community for sharing inspiration, photos, videos, and live experiences. You agree **not** to engage in any of the following prohibited behaviors:
1. **Hate Speech & Discrimination**: Promoting hatred, violence, or discrimination against individuals or groups based on race, ethnicity, religion, disability, gender, gender identity, or sexual orientation.
2. **Harassment, Bullying & Defamation**: Stalking, harassing, threatening, defaming, or intimidating any user or third party.
3. **Sexual & Explicit Content**: Uploading, sharing, or streaming non-consensual sexual content, explicit pornography, sexual solicitation, or any exploitation of minors.
4. **Child Safety & Exploitation**: We maintain zero tolerance for child sexual abuse material (CSAM) or child sexual exploitation and abuse (CSAE). Any occurrence will result in immediate permanent account termination and referral to law enforcement agencies (e.g., NCMEC).
5. **Violence, Harm & Self-Harm**: Depicting or encouraging suicide, self-harm, physical violence, dangerous illegal acts, or terrorism.
6. **Spam & Deception**: Sending unsolicited commercial messages (spam), chain letters, phishing links, misleading giveaways, or operating unauthorized bots.
7. **Impersonation**: Impersonating another person, celebrity, brand, or CHINKY staff.
8. **Malicious Attacks & Hacking**: Distributing viruses, malware, attempting unauthorized access to accounts, servers, or networks, reverse engineering the Platform, or scraping data without written consent.

4. User Content & Intellectual Property
- **Ownership**: You retain full copyright and ownership of any photos, videos, audio, text, or other content you create, upload, or post on CHINKY ("User Content").
- **License to CHINKY**: By posting User Content on or through CHINKY, you grant us a worldwide, non-exclusive, royalty-free, transferable license (with the right to sub-license) to host, store, transcode, display, reproduce, adapt, and distribute your content solely for the purposes of operating, developing, providing, promoting, and improving the Platform.
- **Your Responsibility**: You represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to share your User Content, and that your content does not violate any third party's copyright, trademark, privacy, publicity, or other personal or proprietary rights.
- **Public Content**: Content shared publicly (e.g., public Posts, Flares, or public LIVE streams) may be viewed and shared by other users across the Platform.

5. Content Formats: Picks, Flares, Vibes & LIVE
- **Picks**: High-resolution photo posts and creative carousel imagery.
- **Flares**: Short-form videos, reels, and audiovisual creative clips.
- **Vibes**: Ephemeral 24-hour stories and updates.
- **Audio & Video Calling**: One-on-one encrypted calling features designed solely for private, consensual voice and video communication.
- **Live Streaming**: Real-time video broadcasting. Broadcasters and viewers must follow all Community Guidelines during LIVE sessions. Violations will result in immediate broadcast termination and penalties.

6. Virtual Items, Coins, Wallet & Creator Monetization
- **Virtual Currency**: CHINKY may offer virtual coins, gems, or gifts ("Virtual Items") that users can purchase to support creators or unlock platform features.
- **Non-Monetary Nature**: Virtual Items represent a limited, non-exclusive, non-transferable, revocable license to use digital features within CHINKY. They have no cash value outside the Platform, cannot be transferred to another user outside the Platform, and are **non-refundable** except where required by applicable law.
- **Creator Wallet & Withdrawals**:
- Eligible creators who receive gifts may convert qualifying balances into withdrawal requests subject to identity verification, minimum withdrawal thresholds, and platform transaction fees.
- We reserve the right to review, withhold, or cancel withdrawals if fraudulent activity, chargebacks, policy violations, or unauthorized transactions are detected.
- Creators are solely responsible for any applicable local taxes resulting from earnings or withdrawals.

7. Copyright Infringement & DMCA Takedown
We respect intellectual property rights and respond promptly to notices of alleged copyright infringement. If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notice to **support@chinkyapp.com** containing:
1. Identification of the copyrighted work claimed to have been infringed.
2. Identification of the material claimed to be infringing, with sufficient detail (e.g., post URL, username) to locate it on CHINKY.
3. Your contact information (name, address, telephone number, and email address).
4. A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
5. Your physical or electronic signature.
Repeat infringers will have their accounts permanently deactivated.

8. Content Moderation & Account Suspension
- **Right to Moderate**: We employ automated filters and human moderation to ensure platform safety. We reserve the right, but have no obligation, to review, flag, filter, modify, or remove any User Content that violates these Terms or our Community Guidelines.
- **Suspension and Termination**: We may temporarily suspend, restrict, or permanently terminate your account and access to the Services at any time, with or without notice, if you violate these Terms, create risk or legal exposure for CHINKY, or engage in unlawful activities.

9. Disclaimers of Warranties
- THE SERVICES ARE PROVIDED ON AN **"AS IS"** AND **"AS AVAILABLE"** BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT TRANSMITTED WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHINKY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
1. YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES;
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
3. ANY CONTENT OBTAINED FROM THE SERVICES; OR
4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF **ONE HUNDRED US DOLLARS ($100.00 USD)** OR THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS.
